PREAMBLE: This Constitution is written to govern the actions of the Quincy, IL Area Local of the APWU, AFL-CIO.  Nothing written herein shall conflict with the National Constitution and by-laws.

ARTICLE  1
NAME

This organization shall be known as the Quincy IL Area Local of the American Postal Workers Union, AFL-CIO, hereinafter referred to as the Local.
 


ARTICLE  2
OBJECTIVES

The objectives of this Local shall be to unite all Postal Employees under our jurisdiction, for their economic and social welfare betterment.  To educate all members in the area of economic, political. and social justice.

ARTICLE 3
MEMBERSHIP

SECTION 1

Those accepted for membership shall pay full National Per Capita Tax plus dues as required by the Local Union.  A member's good standing status shall not be affected by reason of the fact that his/her paycheck for the payroll period in which his/her dues deductions are made is insufficient to permit such dues deductions, by reason of illness, injury, pregnancy leave, lay-off or disciplinary suspension.

SECTION 2

A.   Members of this Union who retire from the Postal Service may maintain full membership with all rights of such membership by continuing to pay any full per capita taxes to the APWU plus full dues as required by the Local Union.  They shall receive a ballot from the last craft served while on active duty.

B.   All retirees who desire to become members of the APWU Retirees Department shall pay twenty-four ($24.00) dollars per year per capita tax to the National Union.  Such retirees shall shall elect five (5) delegates to the National Convention.  Each Retiree National Convention Delegate will have a voice and one (1) vote at the National Convention.  The five (5) Retiree National Convention Delegates shall be paid necessary expenses to attend the National Convention.

SECTION 3

Federal classified employees and members who have been promoted to positions exercising supervisory authority may be accepted as associate members for Health Plan participation only.  They shall pay thirty-five ($35.00) dollars per annum to the National Union for this privilege, five dollars of which goes to the Local in the area in which the Federal-classified employee is employed.  They shall have neither voice nor vote in the Local.

ARTICLE 4
REVENUES

The revenues of this Local shall be derived from local dues established by this Local.  In addition, the National Per capita will be withheld in accordance to Article 2, Section 2 of the APWU National Constitution and Bylaws.

The dues for part-time employee members will be based on a percentage of the hours worked during the course of a year.  The percentage will be based on a possible 2080 hours of work per year.  Any part-time employee member who has not met a minimum of 2000 hours per year will be eligible for a rebate of the local dues portion of their biweekly union dues deductions.  Part-time employee members, to be eligible for a rebate, must be in a pay status for the time they are submitting for the rebate.  Rebates will be payable yearly on a calendar year basis.  Members must present a copy of their pay stubs 1 through 26 for the year to the local treasurer to receive the reimbursement.

ARTICLE 5
EXECUTIVE BOARD

SECTION 1

The Executive Board shall consist of the following:
A     President / Delegate to the State Convention
B     Executive Vice President
C     Recording Secretary
D     Secretary-Treasurer
E     Insurance Representative
F     Human Relations / OWCP Director

SECTION 2

The Executive Board shall meet as scheduled by the President or by the request by the majority of the Executive Board.

SECTION 3

The Executive Board may approve expenses up to $300.00 beyond customary and normal expenses between membership meetings.  Any expenditures beyond the specified amount must be approved through a special or general membership meeting.
 

SECTION 4

 

The president shall appoint one member of the executive board, with approval of the executive board, to be authorized as the alternate signature for all banking purposes in the absence of the President or the Secretary/Treasurer.

ARTICLE 6
DUTIES OF OFFICERS

SECTION 1   PRESIDENT / DELEGATE TO THE STATE CONVENTION.

A. The President shall be Chief Spokesperson for all union affairs and official positions of the Local and shall supervise all activities of the Local.

B. It shall be the duty of the President or their designated representative to be Chief Spokesperson at local negotiations.

C. The President shall be an automatic delegate to the State Convention.

D. The President shall fill all elected vacancies with the approval of the Executive Board.

E. The President shall be responsible for the enforcement and interpretation of this constitution and the policies of the Local.

 

F. The President shall appoint all stewards, with the approval of the executive board.

 

G. The President shall appoint all committee members.

H. The President is authorized to approve up to, but not more than $300.00 per month beyond customary and normal expenses between membership meetings.  Any expenses above the stated amount must be approved through a special or general membership meeting.

I. The President will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

SECTION 2     EXECUTIVE VICE PRESIDENT

A. The Executive Vice President shall perform the duties of the President or the Treasurer in the event of their temporary absence or inability to attend to their office.

B. The Executive Vice President shall move up to the President as a result of a permanent removal,.

C. It shall be the duty of the Executive Vice President to render additional assistance to the President as requested.

D. The Executive Vice President will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

SECTION 3     RECORDING SECRETARY

A. It shall be the duty of the Recording Secretary to maintain an accurate written record of the minutes of all regularly scheduled and special meetings and Executive Board meetings of' this Local. The minutes shall. be made available to the membership at each meeting.

B. Maintain an accurate, updated mailing list.

C. The Recording Secretary will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

SECTION  4     SECRETARY-TREASURER

A. It shall be the duty of the Secretary-Treasurer to maintain an accurate accounting of the deposits and disbursements of the Local and to keep an accounting of the property of the Local.

B. Authorized signatures for banking purposes shall include the Secretary-Treasurer and the President.  The appointed and confirmed executive board member for banking purposes shall serve as an alternate signature.

C.     The Secretary-Treasurer shall file all required Department of Labor and Internal Revenue service forms.  He/ She shall submit all financial records to the audit committee upon request.  He/ She shall turn over to their successor all books, papers, records, and documents that are the property of the Local.

D. The Secretary-Treasurer will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

 

E.   The Secretary-Treasurer will be authorized to pay reasonable and customary recurring expenses pertaining to the normal and regular operation of this Local.    (i.e. rent, phone, utilities, insurance, supplies, etc.)

SECTION 5      INSURANCE REPRESENTATIVE (HEALTH AND ABA)

A. To maintain an up to date list of Health Plan and ABA members.

B. To order and maintain adequate supply of health plan and ABA forms.

C. To assist any member desiring assistance with respect to Doctor and/or hospital forms so that the claim can be handled efficiently.

D. The Insurance Representative will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

SECTION 6     HUMAN RELATIONS / OWCP DIRECTOR

A. The Human Relations / OWCP Director shall perform such duties as may be required by his/her office and in compliance with National policy such as civic, community service, retirement or other related programs; promote the Auxiliary and its' programs and policies; shall be active with the AFL-CIO and shall assist with Worker's Compensation issues.

B. The Human Relations Director will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

SECTION 7     CRAFT DIRECTORS

A. The Craft Directors shall be responsible for all grievances from their respective craft. They shall then channel all grievances for processing through the President.  The Craft Director shall serve as Chief Steward for their craft.

B. Policy decisions affecting large number of employees must first be approved by the President and Executive Vice President.

C. Stewards will be recommended for reconsideration by the Craft Director and appointed by the President with the approval of the Executive Board.

D. The Craft Directors will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

ARTICLE  7
APPOINTED COMMITTEES / STEWARDS

SECTION 1     AUDIT COMMITTEE

An Audit Committee shall be appointed by President to audit the books of the Treasurer annually.  In addition an audit must take place during the transition period of any election, and in the event that the office of Treasurer is vacated.  The report of the Audit Committee shall be maintained as a permanent part of the Local.

SECTION 2     STEWARDS AND ALTERNATE STEWARDS

A.  Stewards and Alternate Stewards shall be appointed by the President with approval by the Executive Board.  Recommendation for consideration shall be made by the Craft Directors.  In the absence of the regular Steward, the Alternate Stewards shall assume all duties and responsibilities of the regular Steward and shall work under the direction of the Craft Director and the President.

B. Stewards and Alternate Stewards shall process grievances and work under the direction of the Craft Director and President.

C. Stewards and Alternate Stewards shall attend all Steward and membership meetings unless properly excused by the President.

D.     Stewards and Alternate Stewards shall take the Union's position on issues pertaining to policy, grievances and contract interpretation on the work room floor.

E. The Stewards and Alternate Stewards will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

ARTICLE  8
ELIGIBILITY TO RUN AND HOLD OFFICE

SECTION 1

Any postal employee eligible to be a member of American Postal Workers Union who voluntarily holds a managerial, supervisory or EAS position with responsibility for issuing or recommending discipline, or applying or interpreting the National Agreement for the equivalent of one (1) pay period in a year shall be ineligible to hold office at any level of the American Postal Workers Union (APWU) or to be a delegate to any convention held by the APWU or any subordinate body of the APWU, so long as the employee continues to serve in such position and for a period of one (1) year from the time the employee vacates such position.

Any postal employee who has submitted an application to a managerial, supervisory, or EAS position with responsibility for issuing or recommending discipline or for applying or interpreting the National Agreement shall withdraw such application prior to acceptance of nomination for any office in the APWU.

SECTION 2

Any postal employee who shall voluntarily, after August 31, 1984 holds, accepts or applies for any managerial or supervisory position, EAS position or the PASS program, for any period of time whether for one day or a fraction thereof, either detailed, acting, probationary or permanently, shall immediately vacate any office held by that member in the national, local, area local, district council, state or regional organization, any department of the APWU, the Postal.  Press Association, or any subordinate body of the APWU which receives financial support or uses the name of the American Postal Workers Union.

ARTICLE 9
ELECTION OF LOCAL OFFICERS AND DELEGATES

SECTION 1     ELECTIONS AND TERMS

A. Elections and terms of office shall be one year.  Elected offices consist of the executive board as identified in Article 5, Section 1. Craft Directors elected consist of three crafts -- clerk, maintenance, and vehicle.

B. An election Committee shall be appointed by the President in October of each year.

C. Nominee's names will be posted on the APWU bulletin board within three days after the meeting.

D. At the November membership meeting, nominations will be open from the floor.  At the close of this meeting, nominations for elected offices are closed.  Nominees must accept nomination either verbally or in writing before the close of nominations.  Members may not be a candidate for more than one (1) executive board office.  Candidates for Craft Director must be a member of the craft in which they seek election.

E. Balloting will take place at the December Union meeting.  The results of said balloting will  be known before the end of the meeting.

F. Elected officers shall assume their offices on the first day of the month following the elections.

G. Adequate safeguards will insure a fair election.  Candidates can be their own observers or select an APWU member to observe for them.

H. Officers shall be elected annually by secret ballot by members in good standing.  Craft Directors shall be elected annually by secret ballot only by members in good standing of their respective craft.  An installation of Officers may be held at the next general membership meeting.

I. A simple majority of the votes cast will decide the winner of each office.  In case of ties,  the election committee shall prepare a new ballot and conduct the run-off election as soon as possible.

J. The election committee shall consist of three (3) members.  It is the responsibility of the committee to post notice of the offices to be filled at least fourteen (14) days in advance of the November meeting.  No member of the election committee may be running for office.

K. Any member who is working or out of town on official Union business will be considered present at meetings.

SECTION 2     ELECTION OF CONVENTION DELEGATES

A. Nomination for State Convention delegates shall be held at the March meeting.  The number of delegates and the expenses shall be determined at that meeting.  Election of delegates will be held at the April general meeting.

B.  To be eligible for convention delegate, the member must be in good standing.

C. Delegates will be elected by secret ballot with the members receiving the most votes elected as delegates.  When the quota is reached, the next two nominees will be considered alternates.

D.  Any member who is working or out of town on official Union business will be considered present at meetings.

ARTICLE  10
 ELECTION APPEALS

SECTION 1

Any member who feels aggrieved in connection with the conduct of a Local election, including nomination procedure, shall file their grievance with the election committee within seventy-two (72) hours after their grievance arises.  The election committee shall have the authority to adopt the objectives of this section and where it finds merit as in a grievance, it shall have the authority to direct and impose such remedy as it considers necessary or proper.

SECTION 2

Any member may appeal the decision of the election committee to the National Appeals Committee under Article 21 of the National Constitution.  The appeal must be in writing, shall set forth the relevant fact on which the appeal is based, and shall be filed with the National Election Appeals Committee within five (5) days from the date of the decision appealed from.  Pending appeal, the decision of the Local Election Committee will not be in effect.

ARTICLE  11
APPEALS SYSTEM

SECTION 1

The following procedures shall apply in the event that charges are levied against an officer or any member.

A. The person preferring the charges shall do so by writing specific and detailed charges and presenting them to the Hearing Committee. (If the President is being charged, it should be submitted to the Secretary.)

B.  The President shall appoint a hearing Committee consisting of three (3) members who are not involved in any way with the incident.

C. After a reasonable time to prepare a defense, a full and fair hearing shall be conducted by the Hearing Committee.

D. The Hearing Committee shall report to the next general membership meeting.  A guilty verdict shall then be submitted to vote for acceptance or rejection by the general membership.

SECTION 2

This decision may be appealed under the provisions of Article 14 Section 10 of the APWU National Constitution and Bylaws.

ARTICLE  12
MEETINGS

SECTION 1

Regular meetings of the Local shall be held on a given day and month during the second (2nd) week of the month.  Special consideration will be given during the month of May when the State Convention is held.  The 2nd week may or may not apply.  Notice of the time and place of the meeting shall. be posted at least seven (7) days in advance of the meeting date.  This meeting notice shall be posted by the President.

SECTION 2

A simple majority of the Executive Board members is required to cancel the regular meeting.

SECTION 3

Special meetings and Executive Board meetings may be called by the President or the Executive Board. Written notices of all special meetings must be posted twenty-four (24) or more hours before the opening of the meeting whenever possible.

SECTION 4

A minimum of  ten (10) regular monthly membership meetings will be held each calendar year.  Section 2 of this Article may apply to the minimum amount.

ARTICLE 13
AMENDMENTS
SECTION 1

All amendments to this Constitution must be presented, in writing, read at one (1) general membership meeting and then posted for a minimum of seven (7) days following the meeting.  Discussion and vote is to be taken at the next general membership meeting following the reading of the proposed change.  A two-thirds (2/3) vote is required for adoption.

SECTION 2

The Local's Executive Board has authority to amend this Constitution as necessary to remove any conflict between its provisions and those of any applicable federal or state laws, or the APWU Constitution and by-laws.

ARTICLE 14
SEMINAR AND CONVENTION COMPENSATION

SECTION 1

Any Executive Board member and any Local Union Representative shall be authorized $10.00 per hour or $80.00 per day to attend the following:
              A.  State-sponsored Seminars
              B.  National and State Conventions

 

SECTION 2

 

Any due-paying member who is elected as a delegate and attend State or National Conventions shall receive compensation as in Section 1 above.

SECTION 3

The maximum amount per year for each board member, representative, and elected delegate shall not exceed $800.00.

SECTION 4

Travel time is not to be compensated.

 

SECTION 5

 

When a member has been designated to attend a conference or seminar, compensation will be as follows, in addition to the pay allowed in Article 14, Section 1:

 

a)    The lodging will be paid directly to the hotel or motel involved, at the rate currently being charged for that seminar/convention/meeting, including applicable taxes.

 

b)    Rental car and rental car insurance will be paid directly to the rental company at the negotiated company rate, including applicable taxes.

 

c)    The employee will be paid for meals and incidentals by the per diem rate designated in the GSA federal handbook, and receipts will not be necessary for the meals and incidentals. The meals allowance will be divided as follows: 25% for breakfast, 25% for lunch, and 50% for dinner.

 

d)    The employee must present any and all receipts for approved expenses, such as: gas, toll fees, phone calls, etc. for which they wish to be reimbursed.

 

e)    In the event the employee takes their own vehicle for union business reimbursement for mileage will be at the current GSA rate. The use of the employee's private vehicle may not be reimbursed if a rental car or other transportation is available for the same meeting.

 

f)    The registration fees or seminar fees will be paid by the local for employees designated to attend.

ARTICLE  2

SECTION 1

The order of business may be transposed at any time by a majority vote of members present at a general membership meeting.

SECTION 2

Six members present shall constitute a quorum, but less than that may adjourn at a later date.  If a quorum does not exist within fifteen (15) minutes of the beginning of the meeting, the meeting shall be canceled.

SECTION 3

Roberts Rules of Order as amended, shall be the authority on questions not covered herein.

AMENDMENTS TO THE QUINCY, IL. AREA LOCAL

AMENDMENT  #l - 02/93

The Constitution is hereby amended to read as follows: Craft Directors and Stewards will be awarded dues reimbursement in accordance with the same dues structure and amounts allowed to the members of the Executive Board of the Quincy, IL.  Area Local.

AMENDMENT  #2 - 05/93

The Constitution is hereby amended to add the following language:

AMENDMENT  #3 - 11/93

The Constitution is hereby amended to add the office of Human Relations/OWCP Director as an elected office to the Quincy Area Local.  Said officer will be a member of the Executive Board.  The Human Relations Director shall perform such duties as may be required by his office and in compliance with National policy, promote the Auxiliary and its' programs and policies, shall be active with the AFL-CIO and shall assist with Worker's Compensation issues.

AMENDMENT  #4 - 2/19/95

The Executive Board along with Stewards and Alternate Stewards will be allowed to receive up to, but not to exceed their union dues reimbursement for that fiscal year.  The dues reimbursement will be authorized for attending educational seminars, steward meetings, local union meetings and other meetings called by the President, Vice President, or the majority of the Executive Board.  The rate of reimbursement will be determined by the Executive Board.

This change will replace appropriate paragraphs in the present constitution where it states - Union Dues will be reimbursed in December of each year provided he/she attend all general membership meetings during a twelve (12) month period, or have been excused by the Executive Board.
 
AMENDMENT #5 - 11/99

The Constitution is hereby amended to add the following language:

ARTICLE 14

SEMINAR AND CONVENTION COMPENSATION

SECTION 1

Article 14 - amendment to be added as Section 5.

Article 5 – Executive Board

Section 1, 2 and 3 will remain the same.

 

ADD Section 4

The president shall appoint one member of the executive board, with approval of the executive board, to be authorized as the alternate signature for all banking purposes in the absence of the President or the Secretary/Treasurer.

 

Article 6 — Duties of Officers

The President is authorized to approve up to, but not more than $300 per month beyond customary and normal expenses between membership meetings. Any expenses above the stated amount must be approved through a special or general membership meeting.

Section 2 Executive Vice President

DELETE Item C. The Executive Vice President is authorized to sign checks in the absences of the President or Treasurer. DELETE          This action moves "old D" to "C" and "old E" to "D"

 

Section 4 Secretary/Treasurer (changing B.)

B. Authorized signatures for banking purposes shall include the Secretary/Treasurer and the President. {DELETE The Executive Vice President shall serve as an alternate signature. DELETE} ADD—The appointed and confirmed executive board member for banking purposes shall serve as an alternate signature.

 

 

Article 9 —Election of Local Officers and Delegates

Section 1 Elections and Terms

A. Elections and terms of office shall be for one year.      {DELETE the next sentence of :Officers elected are described in Article 6 Section 1 and Article 6 Section 7 DELETE}        ADD to A. after first sentence the following: Elected offices consist of the executive board as identified in Article 5, Section 1. Craft Directors elected consist of three crafts -- clerk, maintenance, and vehicle.
